Participant agreement

This agreement applies to every class, workshop and session at Purely Mat Pilates, however you book — directly with us, through ClassPass, or through Wellhub. Booking a class means you agree to it.

Booking direct, you accept it at checkout. ClassPass and Wellhub members agree to each studio's waiver under those platforms' own terms, and may be asked to sign on their first visit. Last updated September 14, 2026. Questions? Call or text (917) 612-4579.

PURELY MAT PILATES LLC — PARTICIPANT AGREEMENT

Assumption of Risk, Waiver of Liability, and Release

1. THE ACTIVITIES. I am voluntarily enrolling in movement and fitness instruction offered by Purely Mat Pilates LLC (the "Studio") — including mat Pilates, yoga, stretch and mobility, breathwork and meditation, workshops, special events, private and small-group sessions, and any other movement or wellness class the Studio may offer (together, the "Classes") — held at 62 Main Street, Second Floor, Tuckahoe, New York 10707, and/or delivered by livestream or recorded video. I understand that Classes are instructional in nature: each session is a taught lesson in which an instructor teaches technique, form, and method.

2. ASSUMPTION OF RISK. I understand that physical exercise, including mat Pilates, yoga, and stretching, carries inherent risks that instruction and supervision cannot eliminate — including muscle and joint strains and sprains, falls, loss of balance, contact with equipment or other participants, aggravation of pre-existing conditions, and, in rare cases, serious injury such as broken bones, disabling injury, or death. Classes may involve floor work, standing and balancing postures, use of props (hand weights, resistance bands and loops, stability balls, blocks, straps, bolsters, and Pilates rings), deep stretching and sustained holds, spinal flexion, extension, and twisting, inverted positions, and breathing exercises. I knowingly and voluntarily assume all risks of participating, whether or not described here.

3. MY HEALTH. I represent that I am physically able to participate and that I have had the opportunity to consult a physician about my fitness to do so. I agree to tell the instructor before class about any injury, condition, or limitation that could affect my participation, and to stop exercising and notify the instructor if I feel pain, faintness, or discomfort. I specifically acknowledge that the Studio does not offer prenatal instruction and that many Classes — mat Pilates in particular — include prolonged prone (face-down) work, deep spinal flexion, twisting, and inversions that are not suitable during pregnancy. If I am or may be pregnant, I agree to consult my physician before participating and to tell the instructor before class.

4. RELEASE AND WAIVER. TO THE FULLEST EXTENT PERMITTED BY NEW YORK LAW, I — FOR MYSELF AND MY HEIRS, ASSIGNS, AND LEGAL REPRESENTATIVES — RELEASE AND DISCHARGE PURELY MAT PILATES LLC, ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, INSTRUCTORS (WHETHER EMPLOYEES OR INDEPENDENT CONTRACTORS), AGENTS, AND LANDLORD (TOGETHER, THE "RELEASED PARTIES") FROM ANY AND ALL CLAIMS, DEMANDS, OR CAUSES OF ACTION ARISING OUT OF OR RELATED TO MY PARTICIPATION IN CLASSES OR MY PRESENCE ON THE PREMISES, INCLUDING CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF A RELEASED PARTY. THIS RELEASE DOES NOT APPLY TO GROSS NEGLIGENCE, RECKLESSNESS, OR INTENTIONAL MISCONDUCT, AND DOES NOT WAIVE ANY RIGHT THAT CANNOT BE WAIVED UNDER NEW YORK LAW.

5. THE PREMISES. I understand that the studio is on the second floor and is reached only by one flight of stairs; there is no elevator. I represent that I can use the stairs safely, and I accept responsibility for doing so.

6. MEDICAL CARE. In an emergency, I authorize the Studio to obtain medical care for me at my expense. The Studio does not provide medical services or advice, and nothing an instructor says is medical advice.

7. PERSONAL PROPERTY. The Studio is not responsible for lost, stolen, or damaged personal property.

8. MEDIA. The Studio occasionally takes photos or video during Classes and events for its marketing. If you do not want your image used, tell us in writing (email is fine) and we will honor it; you may also revoke permission prospectively at any time in writing.

9. PARTICIPANTS UNDER 18. Classes are for adults. A participant under 18 may attend only if a parent or legal guardian accepts this agreement on the minor's behalf, and the guardian makes every representation and agreement in this document for the minor.

10. GENERAL. This agreement is governed by New York law; any proceeding must be brought in Westchester County, New York. If any provision is held unenforceable, the remaining provisions — including Sections 2 and 3 — remain in full force. This is the entire agreement between me and the Studio on its subject and replaces any earlier waiver I signed with any prior operator of the premises. By signing electronically, I confirm that I have read this agreement, I understand it, and I accept it voluntarily.
